1. General Agreement & Jurisdiction
Welcome to Otaku's Wonderland. By accessing this storefront, placing an order, or joining the official Otaku's Wonderland Discord server, you explicitly agree to these Terms of Service.
- Legal Entity: Systems Wonderland LLC (DBA Otaku's Wonderland).
- Corporate Residence: Registered in Glen Cove, Nassau County, New York State, USA.
- Governing Law: New York State Law and the Federal Arbitration Act.
- Platform Extensions: These Terms apply across all official sales channels operated by Systems Wonderland LLC, including online storefronts, social media checkouts, and custom invoice portals.
2. Core Business & Pre-Order Deposit Policies
Deposit Structures ("Future Arrivals"): Pre-Order and 'Incoming' figure allocations are secured under a tiered deposit structure:
- US Domestic Orders: Require a 10% deposit at checkout to lock in your allocation slot. Paid deposits represent liquidated damages—a reasonable estimate of our administrative and capital allocation costs—and are non-refundable after 24 hours from purchase.
- International Orders: Feature a 0% deposit protocol ($0.00 due at checkout). A comprehensive invoice for the full item balance + calculated international shipping + applicable duties will be issued prior to fulfillment.
Market Protection & Anti-Scalping: We reserve the right to limit purchase quantities and dynamically adjust pricing models to protect inventory allocation from speculative flipping and scalping.
In-Stock & Secondary Shipping Invoices: Failure to pay a secondary shipping or split-box invoice within 7 calendar days results in a forceful order cancellation and a 10% Restocking & Processing Fee deducted from your refund.
Pre-Orders & Incoming Arrival Invoices: Once your figure arrives at our NY main warehouse, an automated final invoice will be issued. Failure to settle the balance within 30 calendar days constitutes a material breach of contract, resulting in immediate order termination, forfeiture of paid deposits as liquidated damages, and account suspension.
3. Community Conduct & Discord Communications
VIP & Loyalty Programs: Membership in VIP programs or special tier discount groups is a privilege. Systems Wonderland LLC retains absolute discretion to revoke tier status, cancel active discounts, or ban users who exhibit predatory reselling, abusive behavior, or marketplace manipulation.
Electronic Notification Consent: By creating an account or submitting an order, you explicitly consent to receive transactional electronic communications, including arrival invoices, tracking information, and fulfillment alerts via email and official Discord channels.
4. Risk of Loss, Shipping & Carrier Protocols
Transfer of Title: Title and Risk of Loss pass directly to the customer upon transfer of the package to the designated shipping carrier (USPS, UPS, FedEx, or DHL Express).
Carrier Insurance & DDP Processing: International shipments processed via Shopify DDP include prepaid duties and taxes at checkout. All shipments are insured through third-party coverage or carrier policies. In the event of transit damage, customers must inspect packages upon arrival, report physical damage within 48 hours of delivery, and provide clear photographic evidence of both internal and external packaging to facilitate claim processing.
5. Intellectual Property & Automated Access
Proprietary Rights: "Systems Wonderland," "Otaku's Wonderland," "The WonderVault," and all custom site mechanics (including database logic and card game frameworks) are trademarks and intellectual property of Systems Wonderland LLC.
Anti-Botting Guarantee: Automated scripting, data scraping, checkout botting, or attempting to bypass cart restrictions is strictly prohibited and will result in permanent IP termination and order cancellation.
6. Liability & Dispute Resolution (The NY Clause)
"As Is" Standard: ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF MERCHANTABILITY OR FITNESS, EXCEPT AS EXPLICITLY MANDATED BY NEW YORK STATE LAW.
Mandatory Binding Arbitration: ANY UNRESOLVED LEGAL CLAIM OR DISPUTE ARISING FROM THIS AGREEMENT SHALL BE RESOLVED THROUGH BINDING ARBITRATION CONDUCTED IN NASSAU COUNTY OR SUFFOLK COUNTY, NEW YORK. BOTH PARTIES EXPLICITLY WAIVE ANY RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN CLASS-ACTION LAWSUITS.
